Terms of Service

1. Agreement to Terms

By accessing or using Romance Weaver ("the Service"), operated by Romance Weaver ("we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

We may update these Terms from time to time. We will notify you of material changes via email or a notice on the Service. Your continued use after changes constitutes acceptance of the updated Terms.

2. Description of Service

Romance Weaver is a web-based software-as-a-service (SaaS) platform that provides AI-assisted tools for writing romance novels. The Service includes:

• Story planning tools (character creation, plot outlines, story blueprints)
• AI-powered scene generation and editing
• Multi-pass editorial quality system
• Book management and organization features

The Service acts as an interface to third-party AI providers. You are required to provide your own API key from a supported AI provider to use AI generation features.

3. Account Registration

• You must be at least 18 years old to create an account.
• You must provide accurate and complete registration information.
• You are responsible for maintaining the confidentiality of your account credentials.
• You are responsible for all activity that occurs under your account.
• You must notify us immediately of any unauthorized access to your account.

4. Subscription Plans and Billing

4.1 Free Trial

New accounts receive a free trial period with limited features. Trial limitations are displayed on the pricing page and in your account dashboard.

4.2 Paid Subscriptions

• Paid plans are billed on a recurring monthly basis.
• Your payment method will be automatically charged at the beginning of each billing cycle.
• Prices are displayed in US dollars and are subject to change with 30 days' notice.
• Upgrades take effect immediately. You will be charged a prorated amount for the remainder of your current billing period.
• Downgrades take effect at the end of your current billing period.

4.3 Cancellation

• You may cancel your subscription at any time from your Account page.
• Cancellation takes effect at the end of your current billing period. No refunds are provided for partial periods.
• After cancellation, your account will revert to trial-level access. Your content remains accessible but generation features will be limited.

4.4 Refunds

Subscription fees are non-refundable except where required by applicable law. If you believe you have been charged in error, contact us within 30 days of the charge.

5. AI Provider API Keys

• You are responsible for obtaining and managing your own AI provider API key(s).
• You are responsible for all costs incurred through your API key with the AI provider.
• Romance Weaver does not store your API key on our servers beyond your encrypted user preferences.
• You must comply with the terms of service of your chosen AI provider.
• We are not responsible for the availability, pricing, or content policies of third-party AI providers.

6. Content Ownership and License

6.1 Your Content

You own all content you create using the Service. This includes characters, outlines, scenes, and completed manuscripts. We claim no ownership or intellectual property rights over your content.

6.2 License to Us

You grant us a limited, non-exclusive license to store, process, and display your content solely for the purpose of providing the Service to you. This license terminates when you delete your content or close your account.

6.3 AI-Generated Content

Content generated by AI models through the Service is subject to the terms of your AI provider. Generally, AI-generated content is not copyrightable under current law in most jurisdictions. You are responsible for reviewing, editing, and taking ownership of all content before publication.

6.4 Content Responsibility

You are solely responsible for the content you create, including ensuring it does not infringe on any third party's intellectual property rights.

7. Acceptable Use

You agree not to use the Service to:

• Generate content depicting minors in sexual situations
• Create content that promotes violence, hatred, or discrimination
• Attempt to circumvent usage limits or subscription restrictions
• Share your account credentials with others
• Reverse-engineer, decompile, or attempt to extract the source code of the Service
• Use automated scripts or bots to access the Service
• Interfere with or disrupt the Service or its infrastructure
• Violate any applicable local, state, national, or international law

We reserve the right to suspend or terminate accounts that violate these terms.

8. Service Availability

• We strive to maintain high availability but do not guarantee uninterrupted service.
• We may perform maintenance that temporarily affects availability, with reasonable notice when possible.
• AI generation features depend on third-party providers and may be affected by their availability.
• We are not liable for downtime caused by factors beyond our control, including third-party provider outages, natural disasters, or internet disruptions.

9. Data and Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your information.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• The Service is provided "as is" and "as available" without warranties of any kind, express or implied.
• We do not warrant that AI-generated content will be accurate, original, or suitable for any particular purpose.
• Our total liability for any claim arising from or related to the Service shall not exceed the amount you paid us in the 12 months preceding the claim.
• We are not liable for any indirect, incidental, special, consequential, or punitive damages.
• We are not liable for any loss of content, data, or revenue arising from your use of the Service.

11. Indemnification

You agree to indemnify and hold harmless Romance Weaver and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising from your use of the Service, your content, or your violation of these Terms.

12. Termination

• You may terminate your account at any time by contacting us or using the account deletion feature.
• We may suspend or terminate your account for violation of these Terms, with notice when practicable.
• Upon termination, your right to use the Service ceases immediately. We may retain your data for a reasonable period as required by law or legitimate business purposes.

13. Dispute Resolution

Any disputes arising from these Terms or the Service shall be resolved through good-faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, conducted in the state where Romance Weaver is headquartered.

14. General Provisions

• Governing Law: These Terms are governed by the laws of the United States, without regard to conflict of law principles.
• Severability: If any provision of these Terms is found unenforceable, the remaining provisions remain in effect.
• Entire Agreement: These Terms, together with the Privacy Policy, constitute the entire agreement between you and Romance Weaver.
• No Waiver: Failure to enforce any provision does not waive our right to enforce it later.
• Assignment: We may assign our rights under these Terms in connection with a merger, acquisition, or sale of assets.
